Umar Khalid, who is in jail on charges of conspiracy to commit riots in the 2020 Delhi riots case, has approached the Supreme Court seeking his bail. A case has been registered against him under UAPA i.e. Prevention of Unlawful Activities Act and he is in jail. Recently the Delhi High Court rejected his bail plea. Then he appealed to the Supreme Court challenging the judgment of the High Court. Khalid argues that he has been in prison for 5 years. He was not convicted though. He argues that such long detention should be the basis for bail as it is violative of Article 21 of the Constitution. Under which is the right to life and personal liberty. Not much is known about the hearing date of Khalid’s bail plea. However, in view of the importance and sensitivity of the case, there is a glimpse that Khalid’s application may be heard in three to four days. The New Indian Express quoted a senior official of the Supreme Court Registry as saying that the bail plea is likely to be heard in the Supreme Court in three to four days. It is to be noted that on September 2, the Delhi High Court rejected the bail application of nine accused including Umar Khalid. Apart from him, there were Shazil Imam, Gulfisha Fatima, Athar Khan, Khalid Saifi, Salim Khan, Shifau Rahman, Miran Haider and Shadab Ahmed. He sought bail in the high court on the ground that he had no criminal role in the violence in the city’s northeast area or any conspiratorial links with any of the other accused in the case. The Delhi Police opposed Khalid’s bail plea in the High Court. In its decision on 2 September 2025, the Delhi High Court denied bail to Khalid. He said that the allegations against him are serious and serious. Among which was a conspiracy to destabilize law and order. There was prima facie evidence or prima facie evidence relating to his alleged conspiracy. UAPA being a special law required a higher threshold for bail which was not met in Khalid’s case. The court emphasized that the accused cannot be granted bail as he has been in custody for a long time. Especially when the allegations point to a deeper conspiracy. An appeal has been made to the Supreme Court. The issue of Umar Khalid’s bail has been a topic of discussion for a long time.
